Basic information on data processing and legal basis

The following privacy policy gives you an overview of how the MFG guarantees the protection of your data and what type of data is collected for what purpose and to what extent within the website and the associated webpages, functions and content.

This privacy policy applies regardless of the domains, systems, platforms, or devices (e.g. desktop, mobile, etc.) on which the website is displayed or accessed.

You can use the portal at any time without entering any personal data. However, some portal services, such as booking events or subscribing to a newsletter, require entering personal data.

We use terms such as “personal data” or their “processing” in accordance with the definitions in Article 4 of the General Data Protection Regulation (GDPR).

As we continue to develop our website and implement new technologies in order to enhance our services, it may become necessary for us to amend this privacy policy. We therefore recommend that you read the privacy policy again from time to time.

We reserve the right to change the privacy policy in order to adapt it to changed legal situations or in the event of changes to the service and data processing. If the user's consent is required, or components of the privacy policy contain provisions relevant to any contractual relationship with users, changes will only be made with their consent.

Data processing on this website

Within the scope of this website, the MFG processes data:

  • so that you can call up pages,
  • to send the newsletter,
  • when using the contact form,
  • when registering for events or competitions,
  • and for statistical evaluation.

The personal data processed within the scope of this website includes inventory data (e.g., e-mail addresses for the newsletter and contact form), usage data (e.g., the visits to pages within our website) and content data (e.g., entries in the contact form).

We collect this data on the basis of Article 6 Paragraph 1 Letter e of the GDPR in order to be able to provide you with this online service for the performance of our tasks in the public interest.

We only process personal data within the framework of the relevant data protection regulations. This means that user data will only be processed if legal permission has been obtained. This will occur especially if the data processing is necessary or legally required or permitted to provide our services (e.g., processing registrations) and online services or if the user has given their consent.

Voluntary personal details

You have the option of providing personal information voluntarily in some places on the website. In this case, we will only use any personal information you may send us for the purpose for which it was provided.

All information that you receive at these points (e.g. newsletter) is also available to you elsewhere without providing your data. You can also use other ways of contacting us instead of electronic contact options, such as e-mail or the contact form. The voluntary nature of providing personal data is, thus, maintained at all times. You will not suffer any disadvantages if you do not provide your data. You may then have to resort to other ways of obtaining the information.

Consent when registering for an event

When registering for an event, you agree that the transmitted data (name, gender, telephone, e-mail, address, country, industry) may be collected and stored by the MFG (inventory, usage and content data) and used for customer care, evaluation of the usage behaviour, for the needs-based design of our services and for personalised advertising within MFG websites and by e-mail and, if specified, passed on to event partners.

Photo/film and sound recordings can be made as part of events. If you take part in events, you agree that MFG may use the photo/film and sound recordings without restrictions in terms of time and space (on relevant websites, for press reports or similar).

In addition, participant lists are created during events which are made available to all participants and contain the following information: title, surname, first name, company/institution and location. By attending an event, you consent to your contact details appearing on such an attendee list.

We will record your consent to the collection and storage of data. We can inform you, if you so wish, when and how you gave your consent.

If you do not give your consent, please understand that you cannot use the respective service.

Data processing when conducting virtual events

In the following we inform you about the processing of your personal data when participating in virtual events.

We use the "Zoom" video conferencing technology from Zoom Video Communications, Inc., 55 Almaden Blvd, Suite 600 San Jose, California 95113 to hold virtual events.

The processing of personal data by Zoom Video Communications, Inc. takes place on our behalf and according to our instructions on the basis of a contract in accordance with Art. 28 Para. 3 of the GDPR based on the EU standard contractual clauses.

The personal data is processed within the legal framework in Germany, the European Union, the USA and other third countries. The transmission of data to the USA and other third countries as well as the processing there takes place in accordance with the EU-US Privacy Shield and the relevant EU standard contractual clauses. The provider is obliged by contract to ensure the protection of your personal data with technical and organizational measures. An encrypted connection will be established between you and the MFG.

Extent of the data processing

The following personal data in particular are processed as part of the registration on the Zoom infrastructure for participation in virtual events:

  • Last name, first name, company and e-mail address
  • The time and place of your participation in the virtual event
  • Technical data about your devices, network and internet connection such as IP address, MAC address, other device identifiers (UDID), device type, operating system type and version, client version, camera type, microphone or speakers, type of connection and approximate location.

The processing of further data depends on the information you provide before and during your participation in the virtual event and on the functions of the video conferencing technology used.

You may have the option to use a chat, Q&A, or poll features. In this respect, the text you enter will be processed in order to display it during the virtual event as part of the service.

In order to enable the display of video and the playback of audio, the data from the microphone of the terminal device and from any video camera on the terminal device of the participants will be processed during the event. Participants can switch off or mute the camera or microphone themselves at any time using the corresponding functions.

If the event is recorded, files of all video, audio and presentation recordings as well as text files of the online chat will be stored locally.

Legal basis and purposes of data processing

The legal basis for data processing is the contract you entered in for participation in the virtual event in accordance with Art. 6 Para. 1 Letter b of the GDPR and our legitimate interest in checking against misuse of the "Zoom" service in accordance with Art. 6 Para. 1 letter f of the GDPR.

The purpose of processing your personal data is to hold the virtual event using the video conferencing technology required for this. The technical data is required to establish the connection between you and the video conferencing technology used and to improve your user experience when attending the virtual event.

The virtual event is recorded in order to provide the participants with a recording of the event afterwards. If you do not want to be recorded, you can object to this at the beginning of the event. The moderator/speaker will then switch off your image and sound transmission or will ask you to do so yourself. We would like to point out that this may lead to restrictions on participation in the virtual event.

The data will only be used for purposes other than those mentioned above if this is permitted by law or if you have expressly consented to this.

Data recipients

The provider of "Zoom" necessarily receives knowledge of the personal data mentioned, insofar as this is provided for in the context of our order processing contract. If you have your own user account with "Zoom" and are logged in to the service while participating in our virtual event, your personal data may also be processed by the provider Zoom Video Communications, Inc. on its own responsibility. When participating in the virtual event, certain data will also be disclosed to other participants. Your name will appear in the list of participants and can be seen by everyone else. If you switch on your video camera, your picture will also be shown to other participants. If you use your microphone, your voice will be transmitted to other participants. If you send a chat or share content, it can also be viewed by other participants in the chat or in the virtual event. Following the virtual event, each participant will be provided with a recording, which may contain data about you.

Deletion of data

The data processing may be deleted or restricted if the storage of the data is inadmissible or no longer necessary for the above-mentioned purposes. A requirement may exist in particular if the data is still needed to fulfill contractual services, to be able to check and grant or defend warranty and, if applicable, guarantee claims. In the case of statutory retention obligations, deletion is only possible after expiry of the respective retention obligation.

Cookies

This website uses cookies. Cookies are small pieces of text information that are stored as a file in your end device by your browser. These cookies are used to recognize users and enable statistical evaluations. Cookies do not contain personal data. The cookies are used to create non-personal user statistics ("pseudonymous user profiles"). All internet browsers can handle cookies. Most internet browsers are initially set up to automatically accept cookies.

If you want to use the full range of functions of the website, you should set your browser so that session cookies are accepted. You can prevent the analysis of user behaviour if you disable cookies from our website by changing your browser settings, for example by setting up an exception in the browser. You may also object to the use of cookies for reach measurement and advertising purposes via the disabling  page of the network advertising initiative  and additionally the US website or the European website. You can also delete the above-mentioned cookies in your browser on a case-by-case basis or periodically in order to delete tracking information.

Statistical tool

Data is collected and exchanged every time a website is visited. The MFG automatically collects and stores data (log file information) that your browser transmits to our server. This includes general technical information such as browser type, monitor size and operating system used, the IP address of your computer, which websites of the MFG portal you have accessed and the time and duration of your visit. The MFG website uses Matomo, an open source software, for the statistical evaluation of visitor access.

The MFG collects this data in order to carry out tasks that are in the public interest within the meaning of Article 6 paragraph 1 letter e of the GDPR. The MFG evaluates data solely for statistical purposes in order to measure the demand for the website. The MFG has no way to associate this data with a specific person. These data will not be combined with data from other sources. IP addresses are recorded for the duration of the session in order to respond to your requests and are deleted once you leave the site. Data logged during access to the website is only disclosed to third parties in so far as we are obliged to do so by law or under a court order or if disclosure is required for (criminal) prosecution in the case of attacks on our internet infrastructure. Data will not be disclosed for any other reason.

Matomo also uses cookies, which are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is stored on the MFG's web servers in Germany and is not passed on to third parties. The IP address is anonymised immediately after processing and before storage. You may block the use of cookies by selecting the appropriate settings in your browser. However, please be advised that if you opt out of using cookies, you may not be able to use all the features of this website to their fullest extent.

Social plugins

Social plugins are used on our website. These are currently the plugins for the Facebook and Twitter services.

The MFG uses the "Shariff" solution for its social plugins. This solution ensures that no personal data is initially passed on to the providers of the individual social plugins when you visit our website. Only if you click on one of the social plugins can data be transferred to the service provider and stored there. When you activate a plugin, the social media provider receives the information that you have accessed the relevant page of our website. This happens regardless of whether you have an account with this social media provider or are logged in at the time. If you are logged into the provider, your data will be assigned directly to your account. If you click on one of the social plugins and, for example, link the page, the service provider also saves this information in your user account and communicates this publicly to your contacts. If you do not want your profile to be associated with the service provider, you must log out before clicking on one of the social plugins.

The MFG does not collect any personal data using the social plugins or about how they are used. Additionally, the MFG has no influence on whether or how the providers use the transmitted data.

YouTube

Videos from the "YouTube" platform of the third-party provider Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA are integrated into our online offer. If you watch video content on our website, information on user behavior (e.g. opening the video and duration of viewing) is transmitted. Vimeo

Our website includes videos from the “Vimeo” platform from the provider Vimeo, LLC, headquartered at 555 West 18th Street, New York, New York 10011.

If you view pages with embedded Vimeo videos on our website, your browser establishes a connection to the Vimeo servers and the Vimeo content is transmitted directly to your browser. This gives Vimeo the information about which of our pages you have visited. If you are logged in as a Vimeo member, Vimeo may associate this information with your personal user account. You can prevent the information being assigned to your account by logging out of your Vimeo account before using our website.

Flickr

Our website contains image galleries from the Flickr platform owned by Yahoo! Inc., 701 First Avenue, Sunnyvale, CA 94089, USA. Simply calling up a page of our website with an integrated Flickr gallery does not establish a connection to the Yahoo servers, not even when scrolling through the gallery. Such a connection, which enables the provider to collect data on page visits (IP address, surfing behavior), is only established after the user clicks on the preview image.

Newsletter

We regularly send newsletters or status e-mails (hereinafter collectively referred to as “newsletter”) to the e-mail address provided. In these newsletters we inform you, among other things, about upcoming events and provide you with other interesting information.

Simply enter your e-mail address to subscribe to the newsletter. It is also possible to subscribe to the newsletter when registering for events. This e-mail address and the newsletter(s) you have selected will be stored on a server. We only use these data to send the newsletter.

We use the software Newsletter2Go. Your data will be transmitted to Newsletter2Go GmbH. Newsletter2Go is prohibited from selling your data and using it for purposes other than sending newsletters. You can find further information at https://www.sendinblue.com/information-for-email-recipients/.

You may revoke consent to the storage of your data and e-mail address as well as its use for sending the newsletter at any time via the "unsubscribe" link in the newsletter.

The statistical surveys and analyses as well as the logging of the registration process are carried out in accordance with Article 6 Paragraph 1 Letter e of the GDPR in order to carry out our tasks that are of public interest and to prove that consent has been given in accordance with Article 7 Paragraph 1 of the GDPR in conjunction with Article 5 Paragraph 1 Letter b of the GDPR.

LinkedIn

We have a profile on LinkedIn. The provider is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland. Adobe is certified under the EU-US Privacy Shield. LinkedIn uses advertising cookies.

Rights of data subjects

1. Right to information

You have the right to request information without justification about the personal information we hold on you at any time. This also applies to their origin and recipient, as well as the purpose of storage. You will receive this information free of charge (Article 15 of the GDPR). 2. Right to correction of the data

Additionally, you have the right to correct incorrect data, restrict the processing and delete your personal data (Article 16 GDPR, Article 17 GDPR, Article 18 GDPR). If you suspect unlawful data processing, you can lodge a complaint at any time with the supervisory authority responsible (the state commissioner for data protection). 3. Right to object

If we do not process your personal data on the basis of consent but on the basis of a legal fact such as Article 6 Paragraph 1 Letter e of the GDPR, you can object to the future processing of your personal data at any time for reasons arising from your particular situation (Article 21 GDPR).

4. Deleting data

The data stored by us will be deleted as soon as it is no longer required for their intended use, and there are no legal storage obligations to prevent deletion. If the data are not erased because it is necessary for other, legally permissible purposes, the processing of the data will be restricted. This means that the data will be blocked and not processed for any other purposes.

Check your data

You can use any internet browser to see when cookies are being set and what they contain. Detailed information is available at the virtual data protection office of the federal and state data protection commissioners in Germany.

Security measures

We take organisational, contractual and technical security measures in accordance with the state of the art in order to ensure that the regulations of data protection laws are observed and thus to protect the data processed by us against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons.

The security measures include in particular the encrypted transmission of data between your browser and our server.

When contacting us (via contact form or e-mail), the information provided by the user will be processed to manage the contact request and its processing in accordance with Article 6 Paragraph 1 Letter e of the GDPR.

If you e-mail us, we will only use this e-mail and your e-mail address for our correspondence with you. After the request has been fulfilled or answered, your details will be deleted or, if necessary, stored for file-related processes in accordance with the applicable data protection regulations for file management.
